TERMS AND CONDITIONS OF THE COMPANY “BUDJETT MOVERS”


1. Definitions
1.1. “BUDJETTMOVERS” OR “BUDJETT” means SHREE SHANI ENTERPRISES LIMITED and the agents and employees of SHREE SHANI ENTERPRISES LIMITED.

1.2. “Customer” means the person or entity who has instructed BUDJETT MOVERS to provide the Services or any person acting on that person or entity’s behalf.

1.3. “Customer’s Premises” means any place/s or area/s provided by the Customer where the Services will be carried out and includes any surrounding or adjacent place or area that may be necessary to enable provision of the Services.

1.4. “Goods” means the unit/s, article/s, or object/s supplied by the Customer for the provision of the Services.
1.5. “Services” means all services, work or advice provided to the Customer by BUDJETT MOVERS.

1.6. “Standard Rates” means the amounts charged, exclusive of GST, by BUDJETT MOVERS for the provision of Services on an hourly, daily, weekly, monthly or fixed basis which may be reviewed and updated by BUDJETT MOVERS from time to time.

1.7. “Terms and Conditions” means the terms and conditions contained in these terms and conditions of trade.

1.8. “Variation” means any change, deletion, adjustment, and/or alteration to the Terms and Conditions.

1.9. “Vehicle” means any vehicle, truck, or utility, and any item or equipment that may be affixed to the vehicle, truck, or utility, provided by BUDJETT MOVERS for the provision of Services.
2. Introduction

2.1. The supply of Services by BUDJETT MOVERS to the Customer is governed by the Terms and Conditions, unless BUDJETT MOVERS and the Customer agree to a Variation in writing.

2.2. The Terms and Conditions come into force, and are deemed to be accepted by the Customer, when BUDJETT MOVERS accepts instructions from the Customer to supply the Services.
3. Services

3.1. BUDJETT MOVERS will provide the Services to the Customer with all reasonable care and skill as would ordinarily be expected in the provision of such services.

3.2. The Customer acknowledges that it has used its own skill and knowledge in selecting the Services to be provided by BUDJETT MOVERS so that the Services are fit for the Customer’s intended purpose. BUDJETT MOVERS is not responsible for the suitability of the Services for the Customer, subject to subclauses 3.3 and 4.2.2.

3.3. Prior to accepting the Customer’s instructions to provide the Services to the Customer, BUDJETT MOVERS may elect to visit and examine the Goods and/or Customer’s Premises with a view to determining its suitability to provide the Services to the Customer.

3.4. Services will not be provided in respect of Goods which are dangerous, explosive, corrosive, or otherwise likely to cause damage, loss, or injury to any person or property. If it becomes apparent to BUDJETT MOVERS following commencement of the Services that any Goods are dangerous, explosive, corrosive, or otherwise likely to cause damage, loss, or injury to any person or property, BUDJETT MOVERS may immediately cancel provision of the Services and the Customer will pay BUDJETT MOVERS reasonable costs and disbursements incurred up to the time of cancellation. The Customer indemnifies BUDJETT MOVERS against any loss, damage or claim arising from Services provided in respect of Goods which are dangerous, explosive, corrosive, or otherwise likely to cause damage, loss, or injury to any person or property.

4. Customer’s Warranties and Obligations

4.1. The Customer warrants that:
4.1.1. the Customer is the lawful owner or occupier of the Customer’s Premises or has obtained prior to commencement of the Services all necessary permits, approvals, and/or authorisations from the lawful owner or occupier of the Customer’s Premises to enable BUDJETT MOVERS and/or the Vehicle/s to enter upon the Customer’s Premises for the purposes of providing the Services. The Customer indemnifies BUDJETT MOVERS in respect of any loss or damage caused by, or any claim brought against BUDJETT MOVERS, arising from or in connection to the entering upon the Customer’s Premises to enable provision of the Services;

4.1.2. the Customer has lawful ownership of the Goods or has the right and authority on behalf of the owner of the Goods to enter into these Terms and Conditions and instruct BUDJETT MOVERS to provide the Services and that no other person or entity has any charge or lien in respect of the Goods, or right or authority to prevent BUDJETT MOVERS from providing the Services. The Customer indemnifies BUDJETT MOVERS in respect of any claim brought against BUDJETT MOVERS arising from or in connection to breach of this subclause;

4.1.3. the Customer authorizes BUDJETT MOVERS to take any action which BUDJETT MOVERS reasonably considers is in the best interests of the Customer and/or owner of the Goods for the protection of the Goods.

4.2. The Customer will:
4.2.1. pay for the Services, in accordance with clause 8; and
4.2.2. provide to BUDJETT MOVERS all information known to the Customer or able to be obtained by the Customer relating to the Goods, the Customer’s Premises, and the Services required by Customer, to enable BUDJETT MOVERS to determine its suitability to provide the Services, including but not limited to the quantity, type, and specifications of the Goods, and any known hazards or dangers associated with the Goods and/or Customer’s Premises. For the avoidance of doubt, this clause applies despite any investigations carried out by BUDJETT MOVERS for the purposes of determining its suitability to provide the Services;

4.2.3. provide BUDJETT MOVERS with access to the Customer’s Premises and to all amenities necessary for it to carry out the Services;
4.2.4. ensure that the Customer’s Premises remains in such a reasonable state and condition as to enable BUDJETT MOVERS to safely provide the Services.

4.3. The Customer acknowledges that BUDJETT MOVERS may rely on any information provided by the Customer to enable BUDJETT MOVERS to provide the Services. Where BUDJETT MOVERS relies upon information provided by the Customer and thereby accepts instructions to provide the Services, and it subsequently becomes apparent to BUDJETT MOVERS, in its sole discretion and at any time whether or not the provision of Services has commenced, that its Services and/or Vehicle/s is unsuitable or unable to safely perform the Services required by the Customer, BUDJETT MOVERS may cease provision of the Services immediately and will have no liability to the Customer relating to its unsuitability or inability to provide the Services. The Customer will pay all reasonable costs and disbursements incurred by BUDJETT MOVERS by reason of BUDJETT MOVERS reliance on information provided by the Customer.

5. Date for Services and Estimated Completion
5.1. The Services will be provided on a date or dates mutually agreed between BUDJETT MOVERS and the Customer (“Date for Services”), subject to subclause 5.2.

5.2. BUDJETT MOVERS will endeavour to ensure that Services are provided on the Date for Services but does not guarantee the Date for Services. If at any time it becomes apparent to BUDJETT MOVERS that, for any reason whether or not in the control of BUDJETT MOVERS the Date for Services will be unsuitable, it will give notice to the Customer as soon as reasonably possible, and the parties will attempt to agree an alternative Date for Services.
5.3. BUDJETT MOVERS will not be liable for any loss or damage to the Customer arising from or in connection to delay in provision of the Services.
6. Quotation

6.1. Where a written quotation is given by BUDJETT MOVERS for the Services (“Quote”), the Quote will be valid for thirty (30) days from the date of issue and will be exclusive of GST, unless otherwise stated in the Quote.
6.2. The price specified in the Quote may be adjusted prior to the completion of the Services, by written notice to the Customer, if due to circumstances beyond BUDJETT MOVERS reasonable control there will be an increase in the cost of provision of the Services to BUDJETT MOVERS, including but not limited to any delays experienced during provision of the Services.

7. Standard Rates
7.1. Where no Quote is provided by BUDJETT MOVERS for the Services, the Standard Rates applicable at the time the Services are provided will apply to the provision of the Services.

7.2. BUDJETT MOVERS will take reasonable steps to advise the Customer of the Standard Rates that will apply to the provision of Services to the Customer. However, BUDJETT MOVERS failure to advise the Customer of the Standard Rates prior to provision of the Services will not affect the application of the Standard Rates for the provision of the Services to the Customer.

7.3. For the avoidance of doubt, the Standard Rates will apply to all aspects of the provision of the Services by BUDJETT MOVERS to the Customer, including but not limited to any delays experienced during provision of the Services whether or not within the control of BUDJETT MOVERS.
8. Price and Payment Terms

8.1. The price of the Services:
8.1.1. will be calculated in accordance with BUDJETT MOVERS Standard Rates at the time the Services are provided plus GST; or
8.1.2. where a Quote has been provided, will be the price specified in the Quote provided to the Customer plus GST.

8.2. The Customer will pay 75% of the money for the job fixed in ADVANCE PAYMENT and then 25% or remainder money for the Services immediately upon completion of the Services, subject to subclause 8.3.
8.3. BUDJETT MOVERS may, at BUDJETT MOVERS discretion, render invoice/s for the price of the Services, to be provided to the Customer upon completion of the Services and/or from time to time in accordance with BUDJETT MOVERS usual business practices. Payment of the invoiced amount will be due by the Customer from the date of the invoice (“the Due Date”).

8.4. If the Customer fails to pay any invoiced amount within five (5) working days of the Due Date, the Customer will be in default and BUDJETT MOVERS may at its discretion charge interest on the amount owing at a rate of 2% per Week, from the Due Date until the date of payment including after judgment. BUDJETT MOVERS may at its discretion charge a Late Payment fee on the amount owing at a rate of 20%
8.5. The Customer indemnifies BUDJETT MOVERS from and against BUDJETT MOVERS costs and disbursements in recovering any outstanding monies owed, including legal costs on a solicitor and client basis, and any other costs of collection.

9. Liability

9.1. The Goods are at all times throughout the provision of the Services at the owner’s risk and BUDJETT MOVERS will not be liable to the Customer or to any other person for any loss of, damage to, or failure to produce, the Goods by any cause, unless such loss or damage is intentionally caused by BUDJETT MOVERS.

9.2. Subject to subclause 9.1, BUDJETT MOVERS liability for any loss or damage caused directly or indirectly to the Customer in connection with the provision of the Services is limited at BUDJETT MOVERS sole discretion to:
9.2.1. providing the Services again; or
9.2.2. damages not exceeding the price paid by the Customer for the Services.
9.3. Except as otherwise provided at subclause 9.2, and to the fullest extent permitted by law:
9.3.1. All other warranties, whether express, implied or statutory, are excluded; and
9.3.2. BUDJETT MOVERS is not liable for any direct, consequential, indirect or special damage or loss (including loss of profits or revenue) suffered by the Customer or any other person; and
9.3.3. BUDJETT MOVERS will not be liable to the Customer or to any other person in contract (including under any warranty), tort (including negligence), equity or otherwise for any loss or damage of any kind to the Customer, or any other person, under the Terms and Conditions or in relation to any Service provided to the Customer.
9.4. The Customer indemnifies BUDJETT MOVERS against any claim made by a third party for loss or damage however arising in relation to the Services including BUDJETT MOVERS reasonable legal expenses.
10. Insurance
10.1. The Customer acknowledges that BUDJETT MOVERS does not insure the Goods and will have no liability in relation to the Goods pursuant to subclause 9.1. It is the Customer’s responsibility to arrange and maintain any insurance required by the Customer in relation to the Goods and/or Services.
11. Consumer Guarantees Act 1993 (CGA)
11.1. Where the Customer is a consumer under the CGA who acquires the Services from BUDJETT MOVERS other than for the purpose of business, then these Terms and Conditions will be subject to the provisions of the CGA.
11.2. Where the Services are provided for business purposes, the Customer agrees that the provisions of the CGA will not apply.
12. Cancellation
12.1. The Customer may cancel an instruction for Services by giving BUDJETT MOVERS at least 48 hours written notice of cancellation. If the Customer fails to give at least 48 hours written notice of cancellation, in addition to any other rights BUDJETT MOVERS may have, the Customer must pay to BUDJETT MOVERS a cancellation fee of $250 OR the Standard Hourly Rate for round trip fee for Distance Moves cancelled (including GST).
12.2. BUDJETT MOVERS may cancel any instructions for Services which it has accepted if, in BUDJETT MOVERS opinion, it would be unreasonable, impractical, undesirable, illegal or unsafe to complete the Services, if any information supplied by the Customer is materially incorrect, or if in BUDJETT MOVERS opinion satisfactory services cannot be provided.
13. Lien
13.1. Where the Services are subject to a statutory lien, that lien will take precedence over the provisions of subclause 13.2 and subclause 13.2 will not apply.
13.2. Subject to subclause 13.1, the Goods in BUDJETT MOVERS possession are subject to a general lien for any amounts owing by the Customer to BUDJETT MOVERS arising from or in connection to the Services. Where BUDJETT MOVERS retain a lien over the Goods and the Customer fails to pay any invoiced amount within five (5) working days of the Due Date in accordance with subclause 7.3, BUDJETT MOVERS may at its discretion:
13.2.1. sell the Goods by private arrangement or public auction; and/or
13.2.2. dispose of the Goods in any other manner, whether for value or not, as BUDJETT MOVERS see fit.
13.3. Funds recovered from the sale or disposal of Goods will be applied as follows:
13.3.1. first, to pay the costs of and associated with the sale or disposal of the Goods;
13.3.2. second, to all amounts owing by the Customer to BUDJETT MOVERS, including but not limited to any invoiced amounts, interest accrued in accordance with subclause 8.4, costs incurred by BUDJETT MOVERS in accordance with subclause 8.5, and any other costs incurred selling or disposing of the Goods;
13.3.3. third, any excess funds will be paid to the Customer.
14. Dispute Resolution
14.1. Where a dispute or difference arises between the Customer and BUDJETT MOVERS in relation to the Terms and Conditions or in relation to Services provided BUDJETT MOVERS, the parties will in the first instance and in good faith use their best endeavours to resolve the matter between themselves.
14.2. If the dispute or difference cannot be resolved within a reasonable time, then the parties may refer the dispute or difference to mediation to be conducted by a mediator acceptable to both parties. The costs of the mediator will be borne equally between BUDJETT MOVERS and the Customer.
14.3. If the parties do not agree upon the appointment of a mediator within a reasonable period, then the mediator will be appointed by AMINZ.
14.4. Nothing in these dispute resolution provisions limits any right the parties may have to bring a claim before the District Court or the High Court or the Disputes Tribunal.
15. Variation
15.1. BUDJETT MOVERS may vary the Terms and Conditions at any time without notice to the Customer. The New Terms and Conditions will be enforceable by BUDJETT MOVERS from the date they were provided to the Customer.
15.2. The Customer and BUDJETT MOVERS may in writing agree to vary the Terms and Conditions as they relate to the provision of Services from BUDJETT MOVERS to the Customer.
16. Miscellaneous
16.1. The application of these Terms and Conditions together with any annexures referred within are the entire agreement between BUDJETT MOVERS and the Customer and supersede all representation, agreements or other communications made by BUDJETT MOVERS.
16.2. If any part of these Terms and Conditions is illegal, unenforceable or invalid, that part is to be treated as modified or removed to the extent required to make it effective and the rest of these Terms and Conditions are not affected.
16.3. The law of New Zealand must apply to this agreement except to the extent expressly negatived or varied by this agreement.
16.4 The content of these Terms and Conditions should not be copied, reprinted, used or misinterpreted for purposes other then trade between the customer and “BUDJETT MOVERS”.
16.5 Television Sets: Fragile Items: Glassware and Antiques
Please note:
TVs that are not in a box are not covered by our Goods in Transit insurance if damaged. It is the customer's responsibility to box the TV (WE TAKE ALL CARE BUT).

MIRRORS:
ALL MIRRORS SHOULD BE PROFESSIONALLY PACKED. WE ARE NOT RESPONSIBLE FOR DAMAGES. WE WILL DO OUR BEST BUT NO CLAIMS WILL BE CONSIDERED.


Packed Boxes:
Please note that the maximum weight for an item is 20kg, according to OHS regulations. Customers often pack boxes that weigh 40 or 50kg, which is not acceptable. In such cases, we will not accept any claims for damages. It is the customer's responsibility to pack boxes weighing no more than 20kg and with a maximum size of 50cm x 50cm.

Packaging:
All goods are to be packaged and ready to go on Pickup Day. If goods are not packaged, we may cover them with moving blankets for the journey, but no claims will be accepted if furniture /item is damaged or arrives dirty.

Car / Bike / Motorbike Parts:

We do not accept claims for second-hand parts or fittings.

Chest of Drawers:
All chests and drawers must be empty and not filled with clothes or belongings. This makes it harder to lift and increases the risk of breakage during long trips. No claims will be accepted if boxes are filled.

Car Transport

Contract and Commercial Law Act 2017 – Limited Carriers Risk
This means that load carrier is not responsible for damage, theft or vehicle contents. This extends to while in transit, parked or stored. Unless in the unlikely event we are at fault, our insurance covers up to $2000 incl GST for any liable damage only.
All non-runners and pre-damaged vehicles are relocated at the owner’s risk.
We recommend having comprehensive insurance cover in place (Normal full car insurance) and ensuring your policy extends to “in transit between places in New Zealand”. This covers your vehicle when using a professional transport provider, by definition a company with a Transport Service Licence

Terms and Conditions of Agreement for Carriage

In this agreement, the following terms are defined as;
​
CONTRACTING PARTY in this agreement means the person who has requested the Carrier or Forwarder is to carry goods and has the legal authority to do so.
​
FORWARDER means Glen Deal T/A Deal & Sons Removals (D&S)as a forwarding agent to a contracted third-party carrier.
​
CARRIER means D&S as the carrier whether by contract by a forwarder or as a sole agent to the owner.
​
OWNER means the party that has the legal ownership of the goods being carried under this agreement, who may or may not be a direct party to this agreement.
LIABILITY OF FORWARDER (such term to include, unless the context otherwise requires in these conditions, the holding company and its subsidiaries its servants’ agents’ sub-contractors and actual carriers)
(a) The services contracted under this agreement shall be undertaken “at limited carrier’s risk” (pursuant to the Contract and Commercial Law Act 2017) hereinafter referred to as “the Act” unless:
the Contracting Party or their agent has stipulated on this or any other document relating to the carriage of the goods that “these goods are to be carried at ‘owner’s risk’.” This means that the Carrier will pay no compensation to the Contracting Party if any of the goods are lost or damaged unless it can be proven that said damage or loss was intentional; or.
there is a written agreement, signed by the Contracting Party and owner, stipulating that goods are carried at the “owner’s risk”.
(b) In either case (but subject in the case of a contract “at limited carrier’s risk to the limitation contained in Section 259 of the Act)
the Forwarder shall not be under any liability, howsoever caused or arising and (without limiting the generality of the foregoing) whether as a result of the negligence of the Forwarder or otherwise for any damage to, loss, deterioration, mis-delivery, delay in delivery or non-delivery of the goods (whether the goods are or have been in the possession of the Forwarder or not) nor for any instructions, advice, information or service given or provided to any person, whether in respect of the goods or any other thing or matter, nor for any consequential or indirect loss, loss of market or consequences of delay; and
the Contracting Party will indemnify the Forwarder against all claims of any kind whatsoever, howsoever caused or arising and (without limiting the generality of the foregoing) whether caused or arising as a result of the negligence of the Forwarder or otherwise, brought by any person in connection with any matter or thing done said or omitted by the Forwarder in connection with the goods.
With this in mind, please note our prices do not include insurance cover as we strictly cart at “owners risk”. Please discuss with your home and contents insurer if your policy includes goods in transit.
Failure to have home and contents insurance is strongly discouraged
D&S‘s maximum liability in all circumstances is $500 or clients insurance excess, whichever is lesser.
NOTIFICATION OF CLAIMS AND LIMITATION OF ACTIONS
(a) The Forwarder shall be under no liability whatsoever unless:
Written notice of any claim, giving reasonable particulars of the event giving rise to the claim and any alleged damage of loss, is received by the Forwarder within three days after delivery or, in the case of non-delivery, within fourteen days after the date of dispatch;
An action shall have been commenced by the Contracting Party in a Court of competent jurisdiction within six months of delivery or, in the case of non-delivery, within six months and fourteen days of the date of dispatch.
(b) Sections 274, 275, 276, 277, 278, 279, 280 and 281 of the Act shall not apply to the contract.
The Forwarder reserves the right to refuse carriage for any person or for any class of goods.
All terms used in this contract shall have the meanings as set out in the Act, and where the conditions contained in this contract differ from the provisions of the Act then so far as the parties are able the contract prevails over any statutory provision and the parties are deemed to have contracted out of the provisions of the Act and the Forwarder shall not be bound by any agreement varying these conditions unless such agreement shall be in writing and signed with due authority on behalf of the Forwarder.
The goods shall comply with the requirement of any applicable law relating to the nature, labeling and packaging and carriage of goods and the expenses and charges of the Forwarder in complying with the provisions of any such law or with any order or requirement thereunder or with the requirement of any harbour, dock railway, shipping, customs, excise duty, or sales tax, warehouse, or other authority or company or the expenses, charges, levies or fines arising out of the breach of any applicable law shall be paid by the Contracting Party.

The goods shall be safely and properly packaged and labelled and fully described in writing in the space provided hereon including the name and the nature and the value of all goods subject to special rates of carriage or of a noxious, dangerous, hazardous or inflammable nature or capable of causing damage or injury to any other goods or property or to any persons or animals and additional freight charges shall be paid on such goods if deemed necessary by the Forwarder. Failure to safely and properly package or label or to fully describe any goods as aforesaid shall render the Contracting Party liable for any loss or damage whatsoever caused to or by such goods and acceptance caused to or by such goods and acceptance of the goods for carriage without discovery of any such defect or lack shall not exclude or diminish any liability on the part of the Contracting Party.
The Forwarder may charge freight by weight, measurement or value, and may at any time re-weigh or re-value or re-measure or require the goods to be re-weighted, re-valued, or re-measured and charge proportional additional freight accordingly.
QUOTATION SCOPE
Please note all jobs are quoted with a maximum load and unload time of two hours at each end. Should we exceed this time due to access issues or another reason beyond our control we reserve the right to charge $99 per 30 minutes this is exceeded.
Please ensure your inventory is as accurate as possible. We allocate trucks based on this estimate. Failure to list all goods may result in additional charges or items being left behind. If you are concerned please contact us prior to job commencement to discuss. Last minute capacity is often sold at a premium.
A 50% deposit is required for any job over $2000, payable 14 days prior to job commencement. This is non refundable within 72 hours of arrival on-site, unless D&S were to cancel the job.
All jobs are contracted on the understanding that payment is due within 7 days of job commencement unless directly arranged at time of booking. Failure to pay within the allocated time will incur a $49 administrative fee per reminder phone call made. Failure to pay within 30 days will result in your invoice being sent to Marshall Freeman debt collection with the cost of this being passed on to the client. The party contracting D&S‘s services will be liable for all collection costs asscociated with this.

FREIGHT
Freight costs shall be considered earned and shall fall due for payment as soon as the goods are loaded and dispatched by the Forwarder without deduction. Payment of freight costs shall not be withheld or deferred on account of any claim, counter claim or set-off. Should payment in full not be made to the Forwarder within seven days after the due date for payment;
(a) the Contracting Party shall pay interest on all amounts outstanding at a rate which is 5% above the rate charged over the relevant period by the Forwarder’s bankers on primary level overdraft advances to the Forwarder: and
(b) the Forwarder shall be entitled to the recovery of all outstanding freight and interest thereon and Section 283 of the Act shall not apply; and
(c) any costs incurred by the Forwarder in connection with recovery action taken in respect of outstanding freight and other charges shall be payable by the Contracting Party on demand.
If the Contracting Party does not pay the freight within seven days of the date on which the goods are loaded and despatched, then the Contracting Party shall pay the same and all other charges incurred by the Forwarder.
The Contracting Party will be and remain responsible to the Forwarder for all its proper charges incurred for any reasons. A charge may be made by the Forwarder in respect of any delay in excess of 30 minutes in loading or unloading occurring other than from the default of the Forwarder.
Such permissible delay period shall commence upon the Forwarder reporting for loading or unloading. Labour to load or unload the vehicle shall be the responsibility and expense of the Contracting Party or consignee and should the consignee described hereon not be in attendance at the address given during normal trading hours when delivery is attempted an additional charge may be made at ruling rates for each call until delivery is accomplished.
The Forwarder may carry or on-forward all goods or have them carried by any method or any person which the Forwarder deems fit and notwithstanding any instructions that the goods are to be carried or on-forwarded by another method.
The Contracting Party authorises the Forwarder to contact either as Principal or an Agent for the carriage of goods and any such contact will be made upon the terms and subject to the condition of any bill of lading or other forms or terms of contract for carriage, whether by sea, rail, road or air.
From the date on which the responsibility of the Forwarder ceases as provided by Section 258 of the Act the Forwarder may hold the goods if undelivered as bailee and shall be entitled to storage fees at normal rates charged by the Forwarder AND as bailee shall not be under any liability for any loss of or damage to the goods howsoever caused, OR in its discretion return the goods to the Contracting Party at the risk and expense of the Contracting Party. The provisions set out above for recovery of interest and costs on outstanding freight shall apply also to storage fees which remain unpaid seven days after demand for payment has been made.
The Consignor expressly warrants that he is either the owner or the authorised agent of the owner of any goods or property the subject matter of this contract, that the person signing this contract has authority so to do, and by entering into this contract he accepts these conditions of contract as or for the Contracting Party as well as for all other persons on whose behalf the Contacting Party is acting.
D&S does not remove items physically attached to the house or dismantle items unless agreed prior. Please make sure items are ready for transit. Unless prior agreements have been made, items are generally taken as presented and only secured via straps and packed with moving blanets. Please ask about our packing service for more options.
VEHICLE TRANSPORT
In addition to furniture removals D&S also utilises the tow bars on our trucks to tow caravans,trailers and boat trailers on behalf of clients.
If you have contracted us to tow a trailer or any other vehicle, it is mandatory that it have a current WOF and Registration, insurance with our driver listed and be in a condition to handle cross-country travel. In the instance of a mechanical failure or breakdown, we reserve the right to contract a third party for repair to have it to a safe travelling standard, and any costs (mechanical, accomodation, overtime and waiting time due to delay) will be passed onto the client. In the event of a mechanical failure requiring more than 24 hours downtime GD&S reserves the right consider the load forfeited and will leave the vehicle at the repairers until repairs are completed.
Forfeited jobs are considered completed and as such full payment will still be expected, along with any wait times. A new job can be booked if the client wishes to resume transport when repairs are made.
If you have bought the vehicle or trailer sight unseen, these costs will still fall to you and it will be your responsibility to pay and deal with seller for any dispute over costs. Our 7 day payment standard applies to these costs. It is strongly recommend having a third party inspect the vehicle prior to job commencement in these instances.
Please note we do note provide vehicle insurance and client provided insurance is mandatory before D&S commences a job. D&S‘s maximum liability in any circumstance is $500 or the clients excess, which ever is lesser.
GENERAL LIEN
The goods are accepted subject to a general lien for all charges due now or in the past which may hereafter become due to the Forwarder on any account. If the lien is not satisfied within 7 days of such payment becoming due the Forwarder having given notice of the lien may at its option either:-
remove such goods or part thereof and store them in such place and manner as the Forwarder shall think proper and at the risk and expense of the Contracting Party; or,
open any package and sell such goods or part thereof upon such terms as it shall think fit and apply the proceeds in or towards discharge of the lien and costs of sale without being liable to any person for damage thereby caused.
CLAIMS and INSURANCE
In the event that this contract specifies a requirement for insurance the Forwarder as the consignor’s agent will at the cost of the consignor arrange with a lawful insurer insurance of goods. The limit of the cover provided by such insurance as arranged by the Forwarder for the Consignor shall be the amount specified on the face hereof and the following exclusions will apply:-
All claims resultant from wear, tear, moths, vermin, damp, mildew or loss of market, loss damage or expense caused by delay or inherent vice or nature of the subject matter insured.
Gradual deterioration rust and/or oxidation unless due to or consequent upon fire collision overturning or other accident to the conveyance. AND such insurance shall be otherwise on the terms and conditions normally offered for such class of business by the underwriter with whom such insurance is affected PROVIDED HOWEVER that the said limit shall not be construed as an agreed value.
The agreed value shall be the amount representing the value of the goods as invoiced by the consignor with a limit in any event of the amount specified on the face hereof, PROVIDED FURTHER that any amount received by the Contracting Party under such contract of insurance shall be applied in extinguishing the liability of the Forwarder hereunder.
HAZARDOUS GOODS
The Company will not, except in terms of special arrangements previously made in writing to the Forwarder correctly setting out and describing the goods as required by Law, accept or deal with any noxious, dangerous or inflammable goods, or any goods likely to cause damage, or which it is unlawful to carry. If the customer delivers such goods to, or causes such goods to be handled or dealt with by the Company or any sub-contractor or agent, the consignor shall be liable for all loss or damage whatsoever caused by or to in connection with the goods howsoever caused or arising and shall indemnify the Company, sub-contractors and the agents against all penalties, claims, damages, costs and expenses whatsoever arising in connection therewith, and the goods may be destroyed or otherwise dealt with at the sole discretion of the Company, the sub-contractors or any other person in whose custody they may be at the expense of the consignor without the Company, the sub-contractors or such other person being responsible or accountable for the value thereof.

SHIPPER/CONSIGNOR/CONSOLIDATOR DECLARATION
The Contracting Party will confirm acceptance of the goods described herein for forward/shipment for which the above information is declared to be correct.
It is declared that the packaging/s used is (are) of an approved type, labelled or stenciled to indicate the name and class of the goods and the nature of the danger, and that the goods are packed in accordance with all applicable carriers requirements and governmental laws so as to withstand adequately the ordinary risks to handling and carriage by the transport model/s stated above.
In respect of sea voyages, the IMO International Maritime Dangerous Goods Code including Annex 1 shall apply, in accordance with the requirements of the International Convention for the Safety of Life at Sea 1960.
SAFETY
GD&S strives to comply with all aspects of the Health & Safety Act. As result we may politely decline to undertake work which has a degree of unacceptable risk. This includes moving items off balconies with rope, and any other job that staff onsite deem as unsafe. Any unsafe act is reported to a Supervisor or Managing Director who will assess risk before contacting client to dicuss alternatives.
GD&S undersatands moving is a stressful time. However a zero tolerance approach to abuse or violence of any kind is in place in our workplace. Our team have been instructed to leave any situation where a customer is verbally or physically abusive or if they feel threatened in anyway.
We understand moving is a stressful time, but please be kind.

Unless a request for packaging or installation has already been arranged we do not remove items physically attached to the house or dismantle items. This needs to be done beforehand unless we are advised prior and have agreed to prepare for this. Items are generally taken as presented and D&S reserves the right to refuse unpackaged items, particularly fragile items we feel are at risk of breaking or being marked due to our “owners risk” stance.

Please note all jobs are quoted with a maximum load and unload time of two hours at each end. Should we exceed this time due to access issues or another reason beyond our control we reserve the right to charge $99 per 30 minutes this is exceeded. Please note all jobs are contracted on the understanding that payment is due within 7 days of job commencement unless directly arranged at time of booking. Failure to pay within the allocated time will incur a $49 administrative fee per reminder phone call made.

Failure to pay within 30 days will result in your invoice being sent to Marshall Freeman debt collection with the cost of this being passed on to the client.
