TERMS AND CONDITIONS WHEN BOOKING VIA Wise Move - PLEASE READ CAREFULLY BEFORE BOOKING or Quote Accepting - Updated June 2021
A. All deposits are non-refundable unless the job is canceled by us. This is to compensate for the time and dates reserved specifically for your job. If NZ Home Movers (JTL) cancels the job due to unforeseen circumstances, your deposits will be fully refunded.
B. Please ensure your Wise Move inventory is as accurate as possible. We allocate trucks based on this estimate and failure to list all goods may result in additional charges or items being left behind. Last-minute capacity is often sold at a premium.
C. ALL GOODS ARE CARRIED AT THE OWNERS' RISK as per the Carriers Act of New Zealand 1979 . WE DO NOT ACCEPT CLAIMS. (Pls further read below:)
TERMS AND CONDITIONS OF CONTRACT
1. The company’s liability shall be that of a forwarding agent. The company shall not be liable for any loss of, damage to or failure to produce any goods under removal caused by any delay in transit by rail, sea or air, by any strike, labor trouble, riot, civil commotion, war, invasion, Act of God, flood, stress of weather or by moths, borer,
vermin, white ants, termites or other insects, damp, mildew, rot, rust, burglary, housebreaking, storm, tempest or explosion or any act of third party or cause beyond the control of the company nor for any consequential loss however caused.
2. The responsibility for the company’s vehicle and its contents remains with the driver. He has the right at all times to refuse to put his person or his vehicle and its contents at risk. If the owner, consignor, consignee or shipper considers that the driver’s non-acceptance of his/ her instructions is unreasonable, the contractee has complete authority to place a collect call to the head office of the company in order to discuss the matter with the furniture manager.
3. The company will not under any circumstances be liable for any damage to driveway, road, kerb, crossing, path or accessway caused by any vehicle of the company in carrying out its obligations under the contract unless prior to collection or delivery of the goods the company shall have received a written direction from the customer that any such path, road, kerb, crossing, driveway or accessway is unsuitable and that such prior written notice shall have specifically directed the company not to cross any such path, driveway, kerb, crossing, road or accessway with vehicles. In the absence of any such specific written direction the customer shall have been deemed to have directed and authorised the company to cross such path, driveway, kerb, crossing, road or accessway with the appropriate vehicles and the company shall under no circumstances be liable for any damage thereto or destruction thereof.
4. The amount quoted covers the services set out in the quotation and does not include the following services or work but if such services or work are carried out all of the conditions of the contract apply thereto and an extra charge to cover such work will be payable. The services and work excluded are:
(a) The taking down and putting up of fixtures, gas, electric or other fittings or blinds or lifting or laying carpets, linoleums, or other floor coverings, dismantling or installing or reassembling any electrical, audio, refrigerators, washing machines or similar equipment or waterbed, and the removal and re-erecting of any television aerial.
(b) Any storage or related charges or any premiums for insurance unless such insurance is expressly stipulated and referred to in the signed acceptance.
(c) Where delivery is to a building, to the ground floor only, otherwise an extra charge may be charged.
5. When a quotation is for specific items and/or a specific quantity and additional goods are removed, transported or stored an extra charge to be fixed by the company will be made and all these conditions will apply to such additional goods.
6. The company will not accept for removal any goods or substances which is dangerous, explosive, corrosive or otherwise likely to cause damage, loss or injury to any person or property and the customer shall be liable for any such damage, loss or injury, or costs that may be incurred by the company or by any third party through the presence of any such goods or substance. If any such goods or substance is discovered by the company it may at its discretion remove, sell, or destroy or otherwise dispose of the same at the expense of the owner, consignor, consignee or shipper and it shall not be responsible or accountable for the value thereof.
7. It is the responsibility of the customer to see that no article required to be removed is left behind that no goods or fixtures are taken away in error and
that articles left in unoccupied premises are protected.. The company accepts no liability in respect of any such matter and the customer shall indemnify the company against all claims in respect thereof.
8. The company may arrange with any other contractor, railway, steamship, airline, dock or transport company or authority to carry out all or part of the work and terms of all bills of loading consignment notes, and other documents issued by such other parties may be accepted by the company as agents for the customer and shall be deemed to form part of this contract. The company shall transfer to the customer at the customer’s expense the benefit of such rights (if any) as the company may have against such other parties in respect of the customer’s property. The customer acknowledges, agrees and declares that the benefit of any restriction or exclusion of liability on the part of the company hereunder and the benefit to the company of the covenants and obligations on the part of the customer herein expressed apply equally for the benefit of the sub-contractor of the company which performs any part of the company’s obligations pursuant to the provisions of this contract.
13. The effects furniture and goods the subject of this contract will be strictly handled at owner’s risk .
In terms Of the Carriage of Goods Act 1979 this means that the carrier will pay no compensation if the goods are lost or damaged unless he intentionally loses them in transit.
Limited Carrier’s Risk does not cover Household Furniture Removals or Secondhand Furniture in transit. These must be covered separately on an individual basis. (Charges are available on request). Thus all goods carried will be cart at owners risk.
C. Goods carried into the property are taken at the owners' risk. We do not accept any liability for damages to the property at either end. We also act under instructions from our Client who has booked us and no one else
D. If you have asked for only 1 helper , please note that our driver work will be under your instructions and any damages occurring whilst loading, unloading or in transit, will be zero claims basis as well.
E. All quotes quoted on Wise Move doesn't include Packing or Dismantle or Assembly Services - this can be arranged as extras
INSURANCE:
Personal effects, electronics, and household goods are deemed to be transported at the OWNERS' RISK and we do not accept claims pursuant to the Carriage of Goods Act 2015.
Should we be deemed responsible for intentionally damaging or losing items, our maximum liability will be your $200 home and contents insurance excess. You will be asked to file a claim.
We can also arrange Carrier's Liability Insurance.
* Needs to be pre-arranged with us and will incur extra costs, arranged through a third party.
* Maximum Claim for Carrier's Liability: $300 per item (beyond repair) IF insurance is added.
Moving Day:
* All removals must be packed and ready to go.
* We do not assemble or disassemble furniture or move whiteware off cabinets.
* Our staff can assist in putting furniture in rooms, but this is done at the owners' risk. No liability is taken. No assembly or disassembly is included.
Television Sets:
Please note:
TVs that are not in a box are not covered by our Goods in Transit insurance if damaged. It is the customer's responsibility to box the TV (WE TAKE ALL CARE BUT).
Bicycles
Due to some damages, we now have a dedicated Bicycle trailer where we transport Bicycles. It may be delayed by a day or 2 but is safer for both parties
MIRRORS:
ALL MIRRORS SHOULD BE PROFESSIONALLY PACKED. WE ARE NOT RESPONSIBLE FOR DAMAGES. WE WILL DO OUR BEST BUT NO CLAIMS WILL BE CONSIDERED.
Packed Boxes:
Please note that the maximum weight for an item is 20kg, according to OHS regulations. Customers often pack boxes that weigh 40 or 50kg, which is not acceptable. In such cases, we will not accept any claims for damages. It is the customer's responsibility to pack boxes weighing no more than 20kg and with a maximum size of 50cm x 50cm.
Packaging:
All goods are to be packaged and ready to go on Pickup Day. If goods are not packaged, we may cover them with moving blankets for the journey, but no claims will be accepted if furniture /item is damaged or arrives dirty.
Car / Bike / Motorbike Parts:
We do not accept claims for second-hand parts or fittings.
Chest of Drawers:
All chests and drawers must be empty and not filled with clothes or belongings. This makes it harder to lift and increases the risk of breakage during long trips. No claims will be accepted if boxes are filled.
Terms and Conditions for Cancellations:
In the event of cancellations or change of mind, the following applies:
Pickup cancellations 96 hours or earlier:
40% of the full booking cost.
Pickup cancellations 24 to 96 hours prior to pickup:
50% of the total cost.
Pickup cancellations 24 hours or less:
100% of the full cost.
The customer will be billed accordingly and must pay within 2 days. Failure to do so will result in the matter being referred to a debt collection agency such as Baycorp.
Ferries for SOUTH ISLAND BOOKINGS:
If a ferry has been booked and the customer cancels, they will be liable for the full ferry costs. The above cancellation policy also applies.
When booking:
Please note that quotes are based on the inventory list provided on the Wise Move platform. We do not charge by the hour but according to the list provided by the customer. Any additional items will incur extra charges or may be left behind.
PAYMENTS:
Payments must be made on or before the delivery day. No other terms are allowed.
CREDIT CARD payments have a surcharge ad imposed by banks 2.5 to 3.5 %
Unpaid Bills:
Unpaid bills will be referred to collection agencies for collection. All costs will be borne by the customer.
